How to prove sobriety in a child custody case

Learn how to prove sobriety in a child custody case: build a credible record of verified alcohol tests, share results with the right people and present reports.

When alcohol use is raised in a custody or parenting time dispute, saying that you no longer drink is rarely enough. Courts, lawyers and the other parent generally give much more weight to objective, time-stamped records than to personal statements. A consistent record of negative alcohol tests is one of the clearest ways to show that a child is safe in your care.

This article is general information and not legal advice. Every case and jurisdiction is different, so speak with a family lawyer about your situation.

Why objective records matter

Family courts focus on the best interests of the child. In high-conflict cases, each parent often describes events differently, and accusations about drinking can be hard to prove or disprove. Test results that are recorded automatically, verified and shared as they happen replace assumptions with evidence and can help lower conflict between parents.

Steps to build a credible sobriety record

1. Agree on a testing plan

Whenever possible, set out the testing schedule, who receives results and what happens after a missed or positive test in a written agreement, a mediated parenting plan or a court order. A plan both parents accept is harder to dispute later.

2. Test at the times that matter

Alcohol only stays on the breath for a limited number of hours, so tests should line up with your parenting time: for example, before you pick up your children, during the visit and in the evening. Random tests in addition to fixed times make the record more convincing.

3. Make sure every test is verified

A result only carries weight if there is no doubt about who took the test. Remote monitoring that records a video and the location of each test shows that you were the person blowing into the device.

4. Share results with the right people

Results are most persuasive when the other parent, your lawyer or a parenting coordinator can see them as they happen, rather than receiving a summary weeks later. With Druchol, you can add viewers who receive test notifications and can download reports.

5. Keep it up over time

A few isolated tests prove very little. A long, consistent record with few or no missed tests shows a pattern of sobriety and can support requests for longer or unsupervised parenting time.

Handling missed or positive tests

Missed tests are often treated as seriously as positive ones, so plan your day around your testing schedule. If something goes wrong, such as a dead phone or an unexpected result after using mouthwash, explain it right away, take another test as soon as possible and keep a note of what happened. Being open about problems is far more credible than trying to hide them.

Presenting your results

  • Monthly PDF reports show every test in a calendar view with the total, successful, failed and missed tests.
  • Each PDF report has a unique QR code that links back to the original report on Druchol, so lawyers and courts can confirm it hasn't been altered.
  • Raw CSV reports and the video of each test are available if someone needs more detail.

Pair monitoring with support

Monitoring shows what is happening, but courts also look at what you are doing to stay well. Counseling, a treatment program, support groups or recovery coaching, alongside monitoring, show a lasting commitment to sobriety and to your children.
